Website Terms of Use
1. Acceptance of these terms
These Website Terms of Use ("Terms") apply to your use of onaarie.com and related pages operated by O'Naarie Beauté ("we", "us" or "our"). By accessing or using the website, you agree to these Terms. If you do not agree, please do not use the website.
2. Pre-launch website
This is currently a pre-launch information and early-access website. Product images, names, descriptions, ingredients, benefits, packaging, availability and launch timing may be provisional and may change before products become available.
Joining the early-access list does not create a purchase, preorder, reservation of stock, guarantee of availability, or entitlement to a particular price, offer or launch date.
3. Website information is general
Website content is provided for general brand and cosmetic information. It is not medical advice and is not intended to diagnose, treat, cure or prevent any disease or skin condition. Seek advice from an appropriately qualified health professional for personal medical or dermatological concerns.
Individual experiences with skincare can vary. When products launch, follow the instructions, ingredient information and warnings supplied with each product and perform a patch test where appropriate.
4. Early-access communications
If you submit your email address and provide consent, we may send launch updates, product previews, availability information and related marketing. You can unsubscribe at any time. Our handling of personal information is explained in our Privacy Policy.
5. Acceptable use
You must not:
- use the website for unlawful, fraudulent or harmful purposes;
- attempt to gain unauthorised access to the website, server, forms or stored information;
- introduce malicious code, interfere with security or disrupt website operation;
- scrape, harvest or collect information from the website without permission;
- misrepresent your identity or submit another person's email address without authority; or
- copy or commercially exploit website content except as permitted by law or with our written consent.
6. Intellectual property
Unless otherwise indicated, the website and its content, including the O'Naarie Beauté name, logos, branding, text, graphics, layouts, images, videos and other materials, are owned by or licensed to us and are protected by intellectual property laws.
You may view the website for personal, non-commercial use. No other right or licence is granted without our prior written permission.
7. Third-party links
The website may link to third-party services, including Instagram. We do not control those services and are not responsible for their availability, content, security, terms or privacy practices. A link does not necessarily mean that we endorse the third party.
8. Availability and accuracy
We aim to keep the website accurate and available, but do not promise that it will always be complete, current, uninterrupted, secure or error-free. We may update, suspend or withdraw any part of the website without notice.
9. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law, or any other law that cannot lawfully be excluded, restricted or modified.
10. Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss arising from your use of, or inability to use, this pre-launch website. Any exclusion or limitation in these Terms applies only to the extent permitted by law and does not affect non-excludable rights.
11. Changes to these terms
We may update these Terms to reflect changes to the website, our business or applicable law. The current version and effective date will be published on this page. Continued use after an update means the updated Terms apply to your later use.
12. Governing law
These Terms are governed by the laws of New South Wales, Australia. Subject to any rights you have to bring a claim elsewhere under applicable consumer law, the courts of New South Wales have non-exclusive jurisdiction.
13. Severability
If a provision of these Terms is invalid or unenforceable, it will be read down or severed to the minimum extent necessary. The remaining provisions continue to apply.
